Medical Negligence Claim

Patients receiving treatment or care from a medical professional, whether in a hospital or care environment, are entitled to receive a reasonable standard competence in the care process of there stay or visit - the standard which would normally be expected from any doctor, surgeon, nurse or any other medical professional. Procedures, operations and drugs have a risks and side affects attached to them, and if possible these should be explained beforehand to a patient so a decision can be made by the patient whether to take the risk or not. There can only be a valid claim if the standard of care the patient was entitled to was not received, and an injury was suffered as a cause of that.

Medical mis-practice is sometimes very obvious, for example where a swab or dressing is carelessly left inside a patient during an operation. Although in some instances some cases are much more complex investigation, and there may be different medical opinions as to whether the root cause of the "accident" was medical negligence or otherwise.
